How can a Bronx car accident lawyer help me?

A car crash leaves you with medical appointments, calls from adjusters, forms with short deadlines, and often time off work. Our team at Empire Injury Advocates handles the legal side so you can focus on getting better. That usually includes:
Tick

Filing your no-fault application within the 30-day deadline and following up on unpaid medical bills

Tick

Getting the police report, photos, witness names, and any video from nearby businesses

Tick

Talking to the other driver’s insurance company for you, so you do not give a recorded statement that hurts your claim later

Tick

Reviewing your medical records to see whether your injuries meet New York’s serious injury threshold

Tick

Negotiating a settlement, or filing a lawsuit in Bronx County Supreme Court when a fair offer does not come

You can meet the attorneys on our Our Team page.

Where do car accidents happen in the Bronx?

The Bronx has some of the busiest roads in New York City. We regularly hear from people hurt on or near:

  • The Cross Bronx Expressway (I-95), where heavy truck traffic and sudden stops cause rear-end crashes
  • The Major Deegan Expressway (I-87) near Yankee Stadium and the 138th Street exits
  • The Bruckner Expressway and the streets around Hunts Point, where delivery trucks and cars share tight lanes
  • The Grand Concourse, Fordham Road, and East Tremont Avenue, where pedestrians, bikes, buses, and double-parked cars all meet

Common causes include speeding, running red lights, distracted driving, unsafe lane changes, and drivers who do not yield to people in crosswalks. If you were a pedestrian or cyclist, you have the same right to no-fault benefits and the same right to bring a claim.

How does New York no-fault insurance work after a crash?

New York is a no-fault state. Your own auto insurance pays your basic medical bills and part of your lost wages, no matter who caused the crash. Basic coverage pays up to $50,000 per person, including 80% of lost earnings up to $2,000 a month. You must file the application within 30 days of the accident.

No-fault does not pay for pain and suffering. For a full breakdown of what it covers and whose policy pays, read our guide to what New York no-fault insurance pays.

When can I sue the other driver in New York?

To sue for pain and suffering after a car accident, New York law requires a “serious injury” as defined in Insurance Law § 5102(d). Examples include:
Tick

A broken bone

Tick

Significant disfigurement or scarring

Tick

Permanent loss of use of a body part, organ, or function

Tick

A significant limitation in how a body part or system works

Tick

An injury that kept you from most of your normal daily activities for at least 90 of the first 180 days after the crash

You can also sue for medical bills and lost wages that go beyond what no-fault pays. Whether your injuries qualify depends on your medical records, so it helps to keep every appointment and follow your doctor’s treatment plan.

What compensation can I recover?

Every case is different, and no lawyer can promise a result. Depending on the facts, a claim against the at-fault driver may include:
Tick

Medical costs no-fault did not cover, including future treatment

Tick

Lost wages above the no-fault limit, and loss of future earning ability

Tick

Pain and suffering, if you meet the serious injury threshold

Tick

Damage to your car, through the property damage claim

If you were partly at fault, you can still recover. New York follows pure comparative fault under CPLR 1411, so your award is reduced by your share of the blame instead of being wiped out.

How long do I have to file a car accident claim?

There are three deadlines to know:

  • 30 days to file your no-fault application with the insurance company
  • 90 days to serve a notice of claim if a city vehicle, city bus, or a city road defect was involved. See our guide to New York injury claim deadlines
  • 3 years in most cases to file a personal injury lawsuit against a private driver, under CPLR 214

Waiting makes cases harder. Video footage gets erased, and witnesses move or forget.

What should I do after a car accident in the Bronx?

Call 911, get medical care the same day if you can, and tell the doctor you were in a car accident. Take photos of the cars, the street, and your injuries. Get the other driver’s name, plate number, and insurance information. Do not sign anything from the other driver’s insurance company before you talk to a lawyer. Our blog has a longer checklist of 5 things to do after a car accident in New York.

Do you only handle car accidents?

No. Empire Injury Advocates also handles Bronx truck accidents and wrongful death claims. You can read more on our Bronx personal injury lawyer page. We also work with clients in Manhattan, Yonkers, Mount Vernon, and New Rochelle.

Frequently asked questions

How much does a Bronx car accident lawyer cost?

Empire Injury Advocates, PLLC offers a free case evaluation. If you hire the firm, the fee terms are explained in writing before any work starts.

Do I have to go to court?

Many car accident claims are resolved without a trial. Some need a lawsuit filed in Bronx County Supreme Court to move forward. Your lawyer will explain the options for your case.

What if the other driver has no insurance?

Your own no-fault coverage still pays basic medical bills and lost wages. For the rest, you may be able to claim under the uninsured motorist coverage on your policy, or through MVAIC if you have no policy in your household.

Can I still recover if I was partly at fault?

Yes. New York uses pure comparative fault. Your recovery is reduced by your share of fault, but it is not barred.
